1. Agreement

By accessing this site or placing an order you agree to these terms. If you do not agree, do not use the site.

2. Eligibility and age restriction

You must be at least 21 years old and legally able to enter a contract. By ordering you represent that you are 21 or older and that the products you order are legal in your jurisdiction. We may verify age and may cancel any order we cannot verify.

3. Products, pricing, and availability

Product descriptions, pricing, and availability may change without notice. We may limit quantities, refuse or cancel any order, and correct pricing or description errors, including after an order is placed. If we cancel a charged order we refund it in full.

4. Orders and payment

All orders are offers to purchase, accepted when we ship. Checkout and payment processing are performed by Shopify under its own terms. You are responsible for the accuracy of your shipping information.

5. Health disclaimer

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Nothing on this site is medical advice. Consult a qualified healthcare professional before use, especially if you are pregnant or nursing, have a liver condition, or take any medication. Do not combine our products with alcohol or sedatives, and do not drive or operate machinery after use.

6. Assumption of risk

You acknowledge that botanical products, including kava and kratom, carry inherent risks, that individual responses vary, that kratom may be habit-forming, and that you use our products voluntarily and at your own risk.

7. Legal compliance

You are solely responsible for knowing and complying with the laws of your state, county, and city regarding the products you order. We will not ship where the product is prohibited, but you may not order into a prohibited jurisdiction or arrange reshipment into one.

8. Resale prohibited

Products purchased here are for personal use. Commercial resale requires a wholesale account and written authorization.

9. Intellectual property

All site content, trademarks, packaging, and copy are owned by Easy Days Drink or its licensors and may not be copied or used without written permission.

10. User submissions

If you send us feedback, photos, or other content, you grant us a non-exclusive, royalty-free license to use it in connection with our business. You represent that you own it and that it does not violate anyone's rights.

11. Prohibited use

• Misrepresenting your age or identity
• Using the site for unlawful purposes
• Scraping, reverse engineering, or interfering with site operation
• Making medical claims about our products on our behalf

12. Disclaimer of warranties

Except where prohibited by law and except for any express written product guarantee, the site and products are provided 'as is' and 'as available' without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, Easy Days Drink and its officers, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability arising from your use of the site or products is limited to the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify and hold Easy Days Drink harmless from claims arising out of your misuse of the products, your violation of these terms, or your violation of applicable law.

15. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, and you consent to that jurisdiction. Nothing here prevents either party from seeking relief in small claims court.

16. Severability and entire agreement

If any provision is held unenforceable, the rest remains in effect. These terms, together with our other posted policies, are the entire agreement between us.

17. Changes

We may update these terms by posting a revised version with a new date. Continued use after posting constitutes acceptance.
